Agreement to these terms

These Terms of Use govern your use of sportsmgmtpro.com and the Sports Mgmt Pro service (“SMP”), provided by Sports Management Pro, LLC (“we”, “us”). By creating an account or using SMP, you agree to these terms.

If you use SMP on behalf of a club, association or booster board, you agree to these terms for that organization and confirm you have the authority to do so.

The service

SMP gives clubs and associations tools for tryouts, registration, payment plans, field scheduling and communications. Each club gets its own site, where its staff and families sign in. We may add, change or remove features over time.

Accounts

Club admins set up the club’s account and invite staff and families. Whoever holds an account agrees to:

• Give accurate information and keep it up to date.
• Keep their login details private.
• Take responsibility for activity under their account.
• Tell us right away about any unauthorized use.

Plans and fees

SMP costs $99 per year per club, covering unlimited teams, players and payment plans, unless we agree on a different price in writing. Payments collected through SMP carry a processing fee of 4.00% + $0.30 per transaction.

There’s no annual contract and no set-up fee. You can cancel anytime, and your account stays available through the period you’ve paid for. If we change our prices, we’ll tell you in advance and the change will apply from your next renewal. You’re responsible for any taxes that apply to your subscription.

Payments between clubs and families

Families pay the club by card through Stripe, into the club’s own Stripe account. The club is the merchant: it sets its fees, payment plans, discounts, scholarships and refunds, and it handles disputes with its families. Clubs must accept Stripe’s terms to take payments. We provide the tools but aren’t a party to the transactions between a club and its families.

Your club’s data

Your club owns the information it puts into SMP, including player, family and registration records. You give us permission to host, process and display that information only as needed to run SMP for you.

Your club is responsible for having the right to collect the information it asks for. That includes consent from a parent or guardian for players who are minors, and making sure its waivers and agreements are valid where it operates.

Acceptable use

When using SMP, you agree not to:

• Break any law or anyone else’s rights.
• Harass, threaten or mislead players, families or staff.
• Upload malware or anything that could harm the service.
• Try to get into accounts or data you don’t have access to, or test the security of SMP without our written permission.
• Copy, scrape, resell or reverse engineer the service.

Our property

The SMP software, website, name and logos belong to Sports Management Pro, LLC. These terms don’t transfer any of them to you. If you send us ideas or feedback, we may use them without owing you anything.

Third-party services

SMP relies on other services, such as Stripe for payments, and links to sites like Tournament Mgmt Pro and Soccer Tourney Finder. Those services have their own terms and policies, and we aren’t responsible for them.

Suspension and cancellation

You can cancel your club’s account anytime. Export any records you want to keep before you close it. We may suspend or close an account that breaks these terms, puts others at risk or has unpaid fees. Where we can, we’ll warn you first and give you a chance to fix the problem.

Disclaimers

We work hard to keep SMP running smoothly, but it’s provided “as is” and “as available”. To the extent the law allows, we make no warranties beyond those in these terms, and we don’t promise the service will always be uninterrupted or error-free.

Limitation of liability

To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim about SMP is limited to the fees your club paid us in the 12 months before the claim.

Indemnity

Your club agrees to cover us against claims arising from its data, its dealings with its families and staff, or its breach of these terms.

Changes to these terms

We may update these terms from time to time. When we do, we’ll change the date at the top of this page, and we’ll let club admins know about significant changes before they take effect. Using SMP after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the United States and of the state where Sports Management Pro, LLC is organized, without regard to conflict-of-law rules.
